Upon the release of Brokeback Mountain, the conservative film critic, Michael Medved, in a television interview, predicted that a gay western – or maybe he called it a gay cowboy movie – would not attract an audience, presumably on grounds that the intersection of the audience for gay movies and the audience for westerns would yield, as the logicians say, the null set. Medved was proven wrong, as Brokeback, which cost $14 million to produce, went on to earn $83 million (...) on first release in the United States (plus $95 million abroad). But Medved was also wrong in his initial description. Although rodeos, horses, and cattle percolate through the film, Brokeback does not fit the classic American Western movie storyline. From the films of William S. Hart and Tom Mix down through Gary Cooper in The Virginian and High Noon, John Wayne in Stagecoach, Alan Ladd in Shane, and Clint Eastwood in The Unforgiven, the Western hero wears a cowboy hat, rides a horse, and carries a gun. His ultimate goal is to save the good folks from the bad guys, and he always succeeds. Brokeback, of course, is not like these films at all. Jack Twist and Ennis Del Mar are not engaged in the Westerner’s project of vanquishing evil. In fact, Ang Lee’s film more closely resembles the stories of such star-crossed lovers as Abelard and Heloise, Tristan and Isolde, and Romeo and Juliet. More interestingly, it fits a narrative pattern common in the nineteenth-century operas of Bellini, Donizetti, Verdi, and Wagner. In.. (shrink)

An updated and extended second edition supporting the findings of its well-known predecessor which claimed that courts employ common-sense notions of causation in determining legal responsibility.

Roger White objects to interval-valued credence theories because they produce a counterintuitive “dilation” effect in a story he calls the Coin Game. We respond that results in the Coin Game were bound to be counterintuitive anyway, because the story involves an agent who learns a biconditional. Biconditional updates produce surprising results whether the credences involved are ranged or precise, so White's story is no counterexample to ranged credence theories.

Sometimes we must choose between competing claims to aid or assistance, and sometimes those competing claims differ in strength and quantity. In such cases, we must decide whether the claims on each opposing side can be aggregated. Relevance views argue that a set of claims can be aggregated only if they are sufficiently strong (compared to the claims with which they compete) to be morally relevant to the decision. Relevance views come in two flavours: Local Relevance and Global Relevance. This (...) paper presents a trilemma for both. Namely, that neither view can capture our intuition in tie-break cases, without forfeiting our intuitions in other important cases. The paper then presents a way to salvage relevance views and capture all our intuitions using a Hybrid view. By distinguishing between two types of relevance we can combine the strengths of Local and Global Relevance views such that we can hold all our intuitions, consistently and in a non-ad-hoc manner. Building on this, the paper demonstrates how we might amend the strongest formulation of a Relevance view, into a Hybrid account. The main focus of this paper is to develop a relevance view that can capture all the intuitions we have; however deeper justifications will still be needed for a full account of any relevance view. Thus, the end of the paper briefly considers what deeper justification might support the Hybrid view, indicating the direction such literature might go. Lastly, the paper considers the advantages of this view over a rival Hybrid view. (shrink)

In Prophecy without Contempt, Cathleen Kaveny argues that prevailing scholarly approaches to religious and public discourse misunderstand the actual complexity of moral rhetoric in America. She endeavors to provide a better account through study of the role the Puritan jeremiad has played. Kaveny then offers a normative case for deliberative public moral discourse and the limited exercise of prophetic denunciation. I argue that Kaveny's distinction between deliberation and prophetic denunciation is overdrawn. They are ideal types that elide other rhetorical forms. (...) Moreover, both deliberative discourse and prophetic denunciation assume a social contract or shared tradition. Healthy moral discourse requires revolutionary rhetoric to interrogate and break traditions that are themselves morally compromised. (shrink)

In this paper we discuss the question whether God intends that sin occur. We clarify the question, consider some of the answers given in the Christian tradition, and give a careful commentary on a few especially telling passages from the Christian Scriptures. We consider two philosophically informed interpretative strategies, one derived from the work of Frances Kamm, the other from Reformed scholasticism, against our interpretation of these passages. While we concede that in other passages such interpretations may allow a way (...) of escaping our argument, we conclude that in the case of the telling passages we have selected there is simply no comparably plausible alternative interpretation. Transcendental Phenomenology of language wrestles with the relationship of language to mind’s manifestation of being. Of special interest is the sense in which language is, like one’s embodiment, a medium of manifestation. Not only does it permit sharing the world because words as worldly things embody meanings that can be the same for everyone; not only does speaking manifest to others the common world from the speaker’s perspective; but also speaking, as a meaning to say, may achieve the manifestation of (...) the world also for the speaker herself. This requires finding the right words to form true propositions in a well-formed sentences. The manifest telos of proposition-rendering sentences is adumbrated and founded in the infant’s elemental formation of simple phonemic identity syntheses and syntax. This instinctual dynamism is founded in what Husserl names “the idea of truth” which supports the thesis of a universal language instinct. (shrink)

This essay addresses the alienation of aesthetics from ethics in the context of modernity. In examining the modern development of moral theory, it offers a critique of the dominant trends within that tradition, arguing that the result is a fragmented and disordered conception of the good life. Christian ethics, grounded in a conception of the beauty of God’s being as a disclosure of the true good, can reaffirm the connection between ethics and aesthetics, that beauty is not simply a matter (...) of inward reflection but also of action toward the world, which gives content to moral life. Christian ethics ultimately requires a “sense of style” through which we are attracted to a life lived in imitation of Christ, and through which our conceptions of virtue are grounded in a desire to act in such a way as to manifest God’s beauty before the world. The essays in this focus on race and ethics approach the topic from a variety of perspectives. Yet they all advance a basic claim: race—a euphemism for white supremacy—is an ethical issue too often evaded. The essays demonstrate that the ethics of race is integrally bound up with religion, colonialism, and secularism.

The discovery of gold and silver in America, the extirpation, enslavement and entombment in mines of the aboriginal population, the beginning of the conquest and looting of the East Indies, the turning of Africa into a warren for the commercial hunting of black-skins, signalised the rosy dawn of the era of capitalist production.1"In the antiblack world there is but one race, and that race is black. Thus, to be racialized is to be pushed 'down,' toward blackness, and to be deracialized (...) is to be pushed 'up' toward whiteness." This does not mean, of course, that there are only blacks and whites in some anthropological sense. It does not mean that political reality with regard to race simply reduces to two positions... The project of studying children in order to understand them, which lies at the heart of contemporary thinking about children and their education, is misconceived. It rests, jrst of all, upon a false belief that we can only come to know something properly by deliberately and systematically pursuing knowledge of it. Secondly, it offers a paradigm of knowing children which justifies parents and teachers in not giving themselves to children. By re-interpreting the problems that adults experience with children as technical, (...) as arising from lack of information about them, it ignores the personal and moral dimension of adults’ relations with children and thus further alienates them from one another. The advent of Frankfurt-style counterexamples in the early 1970s posed a problem not merely for incompatibilists, but for compatibilists also. At that time compatibilists too were concerned to hold that the presence of alternative possibilities was necessary for moral responsibility. Such a classical compatibilism, I argue in this paper, should not have been left behind. I propose that we can use a Kratzer-style semantics of ‘can’ to model ‘could have done otherwise’ statements in such a way that the truth of (...) such expressions is both (i) evidently consistent with determinism, and (ii) clearly such that Frankfurt-style counterexamples do not count as cases where the agent could not have done otherwise. Demons have the power to cause temptations in us, and Christian materialism implies the supervenience of temptations on brain states. This in turn implies that demons bring about temptations by causally interfering with our brains. But if they have such an ability to affect the physical world, it is mysterious why they do not wreak more havoc than they do both to our brains and in the world more generally. Substance dualism provides an elegant solution: demonic temptation is not a (...) species of soul-to-brain causation, but soul-to-soul, and we don’t need to suppose demons have the power to directly affect the physical world. Materialist solutions, in contrast, are ad hoc. (shrink)

Non-heterosexual men have long existed on the social and cultural margins. Gay and bisexual male characters in literature, too, have done so for many generations. This essay explores the construction of gay masculinity in the short story “Brokeback Mountain” in relation to the “imaginative leap” that its author, Annie Proulx, undertook in order to conceptualize and represent this noteworthy form of marginalized otherness. It demonstrates that, despite the story’s various refreshing elements, “Brokeback Mountain” ultimately relies far too extensively on the (...) logic of melodrama when telling the tale of Ennis del Mar and Jack Twist, who fall in love in 1963 and continue their sexual relationship over the course of two decades. As a result, this story ends up positioning its two queer protagonists as enemies of the patriarchal social order and the larger society within which it so comfortably exists, implicitly perpetuating both heterosexism and homophobia as it does its cultural work.
